Terms and Conditions for the U.S. 50 Mural Project

The U.S. 50 Mural Project (“Project”) is a community-driven initiative aimed at creating a large-scale mural on the Safeway wall along U.S. Highway 50 in Cañon City, Colorado. By submitting artwork, signing up, or participating in the Project in any capacity, you agree to the following terms and conditions:
1. Intellectual Property (IP) Rights
- Community Ownership: All submitted designs, artwork, concepts, and related materials (“Submissions”) will become the property of the U.S. 50 Mural Project and the community of Cañon City, unless explicitly stated otherwise by the artist in their submission.
- Pricing for IP Retention: If an artist wishes to retain ownership of their artwork while granting usage rights to the Project, they must clearly state the price for such rights at the time of submission. If no price is listed, the submission will be considered a donation to the community.
- Usage Rights: By submitting, artists grant the U.S. 50 Mural Project an irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, publicly display, and distribute their artwork for promotional, fundraising, and project-related purposes.
- Credit & Recognition: Whenever possible, the Project will provide public credit to the selected artist(s) in promotional materials and at the mural site.
2. Submission Process & Deadlines
- Submissions must be received by April 10, 2025.
- Artists must submit a draft of their proposed mural design, along with a brief description of the concept and inspiration.
- Submissions must be original and not infringe upon any third-party copyrights, trademarks, or intellectual property.
- Artists may submit designs individually or as part of a team.
3. Selection Process
- The community will vote on submitted designs, with final approval subject to Safeway corporate approval.
- The selection process will consider artistic quality, representation of U.S. 50 and Cañon City, feasibility, and budget.
- Artists of selected submissions will be notified by April 15, 2025.
4. Artist Compensation & Project Budget
- If the selected artist has listed a price for their work, negotiations for compensation will occur before final approval.
- If no price is listed, the work is considered a community donation.
- Any funding for materials, installation, or additional costs will be raised through sponsorships, and community contributions.
5. Liability & Responsibilities
- The U.S. 50 Mural Project is not responsible for any lost, stolen, or damaged submissions.
- Artists must comply with all legal and safety guidelines related to public artwork.
- Selected artists may be required to assist in the execution of the mural, either by painting it themselves or overseeing the process.
6. General Terms
- The Project reserves the right to modify, delay, or cancel the initiative at any time due to unforeseen circumstances.
- Participants waive any claims against the U.S. 50 Mural Project, Safeway, Cañon City, and affiliated organizations regarding the use of their submissions.
- The community reserves the right to make minor modifications to the selected design for practical implementation purposes.
7. Agreement to Terms
By submitting artwork, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
